I AM WRITING to complain about the excessive noise and disturbance at Bellway Homes Warmingham Lane, Middlewich site.

I live directly next to the site on Osprey Close, and over the past few months have noticed an increase in noise levels from the site.

I appreciate that a certain noise level has to take place in the construction of these sites, however I understand that any work carried out must be within certain hours as stated in Cheshire East Council ‘Decision Notice’.

I would like to draw your attention to the hours of work stated in this document as it is apparent the company is not aware of them:- Hours of construction shall be restricted to 8am to 5.50pm Monday to Friday, 9am to 1pm on Saturday, with no work at any other times including Sundays.

This disregard for regulations came to a head this weekend. On Saturday, May 7 at 7.35am my wife and I were awoken by the sound of a digger (and the drivers radio) within 20ft of my property.

The disturbance was such we had to vacate the property for the day.

On Sunday, May 8 we were subjected to a hammering sound from the site until 3pm. Monday, May 9 work began at 6.45am, again the noise was excessive and disturbing. This happens almost every day.

Over the space of just three days Bellway Homes has contravened and ignored this ‘Decision Notice’ set out by the council.

This is not acceptable. Working out of these hours must cease now.

I am writing to find out why Bellway Homes have continuously ignored the working times set out in the Council Notice? Please explain?

I have noticed on the Bellway Homes website that the company have been recognised for its long term commitment to improving the image of the construction industry - called the ‘Considerate Constructors Scheme’.

I am not quite sure how this has been achieved baring in mind the fact you have showed no consideration whatsoever for the local residents of the ‘Warmingham Lane’ site.

I will be writing to the Cheshire East Council on this matter.
